A former Franklin County resident was arrested on capital murder charges Wednesday after authorities alleged he was responsible for the death of his three-month-old son in July 2011.

Pablo Diego Larios, 23, 201 8th Ave. SW, Decatur, was arrested and charged with capital murder on Wednesday afternoon, Franklin County Sheriff Shannon Oliver said.

Oliver said the capital murder charge was warranted since the victim was under 14 years old.

According to Oliver, the alleged incident took place on July 2, 2011, but because of a backlog of cases due to budget cuts and lack of funding, forensic autopsy results have not been available until the sheriff’s office received the official report from the Department of Forensic Sciences on Tuesday listing the cause of death as homicide.

Oliver said once the report had been received, the case was able to move forward.

Oliver said on the day of the incident, the sheriff’s office received a call that a baby located at a residence in the Town and County Trailer Park was not breathing.

Oliver said when officers arrived on the scene, the three-month-old child was still not breathing and was transported to Russellville Hospital where he was unable to be revived and pronounced dead.

Oliver said investigators returned to the residence at the trailer park where they interviewed Larios, who was the child’s father.

Oliver said the mother of the child was not home and he was the only parent at the residence at the time.

“At the time of that interview, the suspect admitted to tossing the child in the air,” Oliver said, “but the forensic results we received on Tuesday listed the cause of death as homicide and stated that the injuries the infant suffered were consistent with shaken baby syndrome and that it appeared to be very violent.”

Oliver said after receiving the autopsy report, investigators obtained a warrant for Larios’ arrest Wednesday morning.

Oliver said investigators received word that the suspect had moved from his residence in Franklin County to a home in Decatur so the FCSO contacted the Decatur Police Department who assisted them on the arrest on Wednesday afternoon.

“We are relieved that an arrest has finally been made in this case after we have been pursuing it for almost two years,” Oliver said.

“It’s disheartening that because of budget cuts and a lack of funding that a case like this took so long to be resolved. It’s hard on the families to have to wait for answers, so we are glad the case can finally move forward.”

Larios is in custody at the Franklin County Jail without bond at this time.

Franklin County District Judge Paula McDowell denied bond at a hearing on Thursday afternoon.

If convicted of capital murder, Larios could face the death penalty.

JACKSONVILLE, Fla. -- A Jacksonville man was convicted Friday of manslaughter and aggravated child neglect in the death of his 5-month-old son.

In November of 2011, 5-month-old Cordero Webber Jr. was home with his mother and father when the mother, Kierra Laird, found her son not breathing. Evidence in the case showed the infant suffered a blow to his head and died at home.

Doctors discovered multiple bruises on the baby's cheeks, chin, head and ears. The child suffered from severe malnutrition and his brain was half the normal size. Doctors say the baby stopped growing due to trauma. They also found the baby had rib fractures from a prior assault.

The father Cordero Webber Sr. faces up to 45 years in prison in the case. He will be sentenced July 8.

Laird is also charged in the case. She pleaded guilty to child neglect. Her sentencing is scheduled for June 17.

It is not made clear here whether dad JAMES GARCIA had full custody, joint custody, or just visitation rights. For the murdered boy, it really didn't matter....

Dad gets only five years in prison. Most moms get much longer for "failing" to stop their violent boyfriend.

Man says he 'failed' as a father when 4-year-old son died

MAGOFFIN COUNTY, Ky. (WKYT) - He says he failed as a father.

An eastern Kentucky man who admitted causing the death of his 4-year-old son spoke out from jail Friday.

It came a day after a Magoffin County judge sentenced James Garcia to five years in prison for reckless homicide.

Investigators say Garcia's son, Cameron, died of blunt force trauma in 2011.

Garcia says he was at work when the child was injured. He says his live-in girlfriend was watching Cameron at the time.

"I wasn't there for him (Cameron)," Garcia said. "I guess I should have sat there and watched him 24/7 but I put her trust in him."

Garcia says he pled guilty to reckless homicide because he felt he needed to take responsibility for his son's death.

During Thursday's sentencing, the child's mother lunged at Garcia.

Garcia says he wasn't surprised that happened. He says he understands she's in pain.

Colorado Exoneree to Receive Compensation

In the year since his exoneration through DNA testing, Robert Dewey has been living hand to mouth without the compensation that could help him rebuild his life. That is about to change this week, when the governor signs a compensation bill into law.

When passed, the Compensation for Persons Wrongly Convicted bill will compensate Dewey over $1,000,000, minus federal taxes, for his nearly 18 years of wrongful imprisonment. He will also be eligible for four years of higher education on the state's tab, reported The Denver Post.

Dewey, who has survived on Social Security payments of about $600 a month and $87 in food assistance, testified before the Legislature earlier this year about his needs as a 52-year-old man suddenly turned back into the world with no job skills and no financial resources.


"I'm like a deer in the headlights," he told lawmakers, some of whom cried over his story.

Dewey, a motorcycle enthusiast, plans to ride to the state Capitol on Wednesday to see the legislation signed. According to the legislation, Dewey and future exonerees will have to obtain health insurance and complete a financial management course. The measure also specifies that a future Class 1 or 2 felony conviction will discontinue the compensation.
