An independent review of the New York City medical examiner's office suggests a management change, legislation in Minnesota attempts to require accreditation for crime labs, and Ohio law enforcement addresses a backlog of DNA cases. Here is the round up of news for the week:

An independent review found that recent problems at the New York City medical examiner's office should lead to a wide-ranging management change. After missing and mixing biological evidence in numerous cases, and the resignation of various staff, the review showed systemic problems dating back several years.

In Minnesota, the problems with a lack of protocols at the St. Paul crime lab spurred a bill that would require accreditation for crime labs throughout the state. The author, Senator Ron Latz, believes the bill will "prevent wrongful convictions and increase public confidence in the criminal justice system."

Due to numerous problems with management, evidence processing, and a DNA backlog, local law enforcement agencies in Ohio are no longer sending biological samples to the Canton-Stark County Crime Lab. Law enforcement officials still support the crime lab but feel the Ohio Bureau of Investigation crime lab can do a more effective job conducting DNA testing.

A New Zealand researcher is determining how the psychology of juries is impacted by expert forensic evidence and how that interaction affects the integrity of the justice system. The research will examine how juries deliberate conflicting interpretations of evidence given by prosecutor and defense experts.

An investigation from January leads to the arrest of a father accused of sexually assaulting his daughter.

33-year-old Martin Angel Espitia was arrested overnight Thursday.

According to the investigators, the victim was his daughter. She was 11 when the assaults started.

She told investigators that it started out as touching and escalated. The victim never told anyone because she was scared.

Espitia denied the allegations. He was given the opportunity to take a polygraph, but refused.

He was arrested and charged with sexual assault of a child and is being held in the Brazos County Jail under $50,000 bond

Father charged in death of 10-week-old girl

LEXINGTON, Mo. — The father of a 10-week-old girl who died after suffering a fractured skull and brain damage has been charged in her death.

Prosecutors charged Alex Gilbert, 24, with one count of second-degree murder.

According to the Lafayette County Sheriff’s Office, deputies responded to a home on Linn Road in southwestern Lafayette County on May 17. An infant was reported to be unresponsive and was having trouble breathing.

The child was transported to St. Mary’s Hospital in Blue Springs were medical staff discovered the infant had sustained a number of injuries. She was then transferred to Children’s Mercy Hospital in Kansas City, Mo., where she died on May 20.

According to the Jackson County Medical Examiner who performed an autopsy, the infant suffered numerous broken bones, including a fractured skull, contusions and brain damage. Due to his findings, the medical examiner ruled the child’s death a homicide.

Gilbert’s father told FOX 4 his son would never harm a child and believes investigators are just looking for someone to blame.

Gilbert is being held on $500,000 bond.

Father accused of assaulting 5-week-old girl

EVERETT -- The April photo on his social media site shows a smiling young father with a baby cradled in his arms.

A month later, the Everett teen is in the Snohomish County Jail and his five-week-old daughter is at a Seattle Children's Hospital where she's being fed through tubes and is on anti-seizure medication.

She suffered a skull fracture, bleeding and swelling in her brain as well as two broken ribs, according to a police report.

An Everett detective wrote that the baby girl will be a long-term rehabilitation patient.

"The prognosis at this time is that she will likely have brain damage and vision impairment," the detective wrote Wednesday. "The extent of damage is unknown at this time."

Her dad, 18, was arrested Wednesday for investigation of first-degree assault of a child. He has not been formally charged.

Everett police spokesman Aaron Snell said the girl's mother appears not to have known anything about the alleged abuse.

"He is the only suspect based on what has been said and written," Snell said.

The Everett couple called 911 on Wednesday after the baby seemed lethargic and had trouble breathing. She was taken to Providence Regional Medical Center Everett before being transferred to Children's.

Doctors became suspicious of the parents' explanations for how the injuries occurred. They called state Child Protective Services and the Everett Police Department.

The suspect initially told authorities that he was holding the girl in a bedroom when she pushed her body up and hit her head against his chin. The mother said she had no idea how her child could have sustained a head injury.

In a follow up interview with a detective, the suspect allegedly admitted to getting angry when the baby was fussy and wouldn't stop crying.

"He described shaking (her) in vigorous, short, repetitive movements in an attempt to stop her fussiness," the detective wrote. "He described shaking her once or twice a week since she was two weeks old."

He allegedly said the baby began having problems after he shook her Wednesday. "He also admitted to squeezing her forceful enough to break her ribs," the detective wrote.

"(He) said the impact to her head occurred when he inadvertently slammed the back of her head against the wall earlier in the week."
